Your privacy matters. This privacy statement explains how Kirsten Čápová, based in Oegstgeest, the Netherlands (“I”, “me” or “my”), handles personal data when you visit this website, contact me about piano lessons or become a student or customer.

My website and services are intended for people in the Netherlands. My students may include children.

who is responsible for your personal data?

which personal data do I process?

Depending on how you use my website and services, I may process:
 

  • your name, email address, telephone number and, where needed, address;

  • the name, date of birth and relevant details of a student;

  • details of a parent or guardian where the student is a minor;

  • bank account details of the person paying lesson fees;

  • information you provide when enquiring about or arranging piano lessons;

  • information needed to administer lessons, appointments, payments and invoices;

  • correspondence and other information you voluntarily provide;

  • photographs taken during lessons, performances or recitals;

  • technical information generated when you visit the website, such as IP address, browser or device information and cookie information; and

  • information relating to online advertising where Google Ads or similar functionality is used.

I do not intentionally collect more personal data than I reasonably need. Please do not send sensitive personal information unless it is genuinely necessary for arranging or providing lessons.

why do I process personal data?

I process personal data only where I have a legal basis for doing so.

 

QUESTIONS AND LESSON ENQUIRIES

If you contact me because you are considering piano lessons, I use the information you provide to answer your questions, discuss lesson options and make arrangements before lessons start. The legal basis is taking steps at your request before entering into a contract.

PROVIDING PIANO LESSONS

I process information needed to schedule, organise and provide lessons and communicate about them. The legal basis is the performance of our agreement.

ADMINISTRATION, INVOICES AND PAYMENTS

I process information necessary for my administration, invoices and financial records. The legal basis is the performance of our agreement and, where applicable, compliance with legal obligations such as tax and accounting requirements.

OPERATING AND SECURING THE WEBSITE AND MY SYSTEMS

I may process technical information where necessary to operate and protect my website, email, storage and other systems. The legal basis is my legitimate interest in running my teaching practice safely and effectively.

ADVERTISING SERVICES

If I use Google Ads or similar advertising functionality, related personal data will only be processed where permitted by law. Where consent is required, advertising cookies or similar technologies will only be activated after you have given consent.

LEGAL REQUIREMENTS AND CLAIMS

I may process or retain personal data where necessary to comply with the law or to establish, exercise or defend legal claims.

photos

I may occasionally take photographs in connection with lessons, performances or recitals.

PRIVATE LESSONS

Recognisable photos taken during private lessons will only be published or otherwise used with the consent of the person concerned. For a minor, I will obtain the consent of a parent or legal guardian where required. Consent is voluntary and can be withdrawn at any time by emailing info@kirstencapova.com.

PUBLIC PERFORMANCES AND RECITALS

I may take and use photographs of public performances or recitals to document and communicate about my teaching practice and musical activities. Where appropriate, the legal basis is my legitimate interest in documenting and communicating about these events.

I will take reasonable account of the privacy of people shown, particularly children, and generally prefer photographs showing the event or performance rather than unnecessarily focusing on individuals.

 

If you or your child is recognisable in such a photograph and you object to its use, please email info@kirstencapova.com. You have the right to object to processing based on legitimate interests and, where applicable, to request removal or deletion of the photograph. If you prefer not to be photographed at an event, you can also let me know in advance.

personal data of minors

Many of my piano students are children, so I may process personal data relating to minors where necessary to arrange and provide lessons.

 

I only process information that is reasonably necessary for this purpose and will normally communicate with a parent or legal guardian where appropriate.

 

Where the processing of a minor’s personal data requires consent, I will obtain the consent required under applicable law. I do not knowingly use children’s personal data for personalised advertising.

how and where do I store personal data?

Personal data may be stored on devices and in systems I use for my teaching practice, including my email account, telephone, computer, cloud storage and administrative systems.

 

I take reasonable technical and organisational measures to protect personal data against loss, misuse, unauthorised access, alteration or disclosure.

 

Some service providers may process or store personal data outside the Netherlands or the European Economic Area (“EEA”). Where personal data is transferred outside the EEA, I use providers and arrangements that comply with applicable data-protection requirements, such as an adequacy decision or appropriate contractual safeguards.

how long do I keep personal data?

I keep personal data only for as long as reasonably necessary for the purpose for which it was collected, unless the law requires or permits a longer period.

 

In general:

  • enquiries that do not result in lessons are deleted when they are no longer reasonably needed, normally within 12 months;

  • information about students is generally kept for the duration of the teaching relationship and for a reasonable period afterwards where necessary for administration or legal claims;

  • invoices and other financial records are kept for the period required by Dutch tax and accounting rules;

  • correspondence is kept only for as long as reasonably necessary; and

  • cookie-related information is retained for the applicable cookie period or until consent is withdrawn, where applicable.

 

When information is no longer needed, I delete or anonymise it where reasonably possible.

do I share personal data with others?

I do not sell personal data.

 

I only share personal data with third parties where reasonably necessary to operate my teaching practice, provide my services or comply with the law. These may include providers of:

  • website hosting and domain services;

  • email and telecommunications;

  • cloud storage and backup;

  • IT and website services;

  • payment, bookkeeping or administration services; and

  • advertising services such as Google, where applicable.

 

Where a service provider processes personal data on my behalf, I use appropriate arrangements as required by applicable data-protection law.

 

Some providers may be located outside the EEA. In that case, I take reasonable steps to ensure that an appropriate legal mechanism for the transfer is in place.

 

I may also disclose personal data where required by law, a court or a competent public authority.

My website may use cookies and similar technologies.

 

Functional cookies are used where necessary to make the website work properly, provide requested functionality or maintain security. Where permitted by law, these may be placed without your consent.

 

Google Ads and third-party cookies may be used for advertising and measuring advertising performance. Where consent is required, these cookies or technologies will only be activated after you have given consent through the website’s cookie settings. You can withdraw your consent through those settings.

 

Third-party providers may process information collected through their technologies in accordance with their own privacy policies.

Under the GDPR and other applicable data-protection legislation, you may have the right to:

  • access your personal data;

  • have inaccurate or incomplete data corrected;

  • have personal data deleted in certain circumstances;

  • restrict the processing of your personal data;

  • object to processing based on legitimate interests;

  • receive certain personal data in a portable format;

  • withdraw your consent at any time where processing is based on consent; and

  • object to direct marketing.

 

These rights are not absolute. In some circumstances, the law permits or requires me to continue processing or retaining certain information.

 

To exercise your rights, send an email to info@kirstencapova.com and explain your request. I may ask for additional information where reasonably necessary to verify your identity. I will respond within the period required by law.

 

If you believe that I have not handled your personal data correctly, you also have the right to lodge a complaint with the Dutch data-protection authority, the Autoriteit Persoonsgegevens.

automated decision-making

I do not use personal data for decisions based solely on automated processing that have legal or similarly significant effects on you.
